Ala. Court Throws out Asbestos Claims Against Engine Defendant, Cites Bare Metal Defense

MOBILE, Ala. –– An Alabama federal court has thrown out asbestos claims asserted against an engine defendant, finding they are barred by the bare metal defense.
In the Aug. 4 opinion, the U.S. District Court for the Southern District of Alabama wrote that Cummins Inc. could not be held liable for products it did not manufacture or supply.
The plaintiffs contended that the decedent was exposed to asbestos-containing products manufactured by a number of companies. They asserted that the decedent came into contact with the products while serving in the U.S. Navy and U.S. Coast Guard.
