N.Y. Court Declines to Award Summary Judgment to Goodyear, Says Questions of Fact Exist

NEW YORK –– A New York trial court has rejected efforts by Goodyear Tire & Rubber Co. to obtain an award of summary judgment in an asbestos case, noting that the defendant had conceded that tiles it manufactured during the time period in question contained asbestos.

In the July 8 order, the New York Supreme Court for New York County concluded that “any discrepancy here between plaintiff’s testimony and that of defendant’s witnesses and records at trial is for a jury to decide.”
