N.J. Court Dismisses Defendants, Says Claims Barred by Bare Metal Defense; Plaintiffs Appeal

TRENTON, N.J. –– Plaintiffs with asbestos claims in New Jersey have indicated their intent to appeal three recent orders in which a federal court awarded summary judgment to CBS Corp., Foster Wheeler LLC, and General Electric Co. on the ground that the bare metal defense barred the claims.

The July 2 notice of appeal came after the U.S. District Court for the District of New Jersey remanded the case sua sponte on June 26, saying that the claims giving rise to removal had been disposed of.
