Ala. Court Asks State High Court to Weigh in on Premises Owner Liability, Causation Standard for Multiple Exposures

BIRMINGHAM, Ala. –– An Alabama federal court has asked the state high court to weigh in on “two unsettled questions of Alabama tort law” relating to the scope of duty owed by premises owners to non-employees and the causation standard when a plaintiff’s injury is a result of multiple exposures to asbestos.

In the June 22 order, the U.S. District Court for the Northern District of Alabama opined that there was no clear, controlling precedent in the state for these issues and further found that “their significance extends beyond the present case.”
