Wash. Court Affirms Dismissal of Asbestos Wrongful Death Claims, Says Decedent Had No Valid Action at Time of Death

SEATTLE –– A Washington appellate court has affirmed the dismissal of an asbestos-related wrongful death suit, saying that the decedent had no valid cause of action against the defendants at the time of his death, making his daughter’s lawsuit also untimely.

In the June 22 opinion, the Washington Court of Appeals, Division One, wrote that case law in the state does not support the plaintiff’s argument that “would revive a wrongful death action when an individual dies no matter what was or was not already litigated during his lifetime.”
