Calif. Court Reverses Award of Summary Judgment in Asbestos Case; Says Claims Fit Tellez-Cordova Exception

LOS ANGELES –– A California appellate court has reversed an award of summary judgment in an asbestos exposure suit, finding that the plaintiffs’ claims relating to an automotive maintenance machine fit an exception outlined in O’Neil.

In the June 18 ruling, the California Second District Court of Appeal, Division 4, wrote that the claims fell into the exception because they are predicated on the intended use of the machine.

The plaintiffs asserted the action on behalf of Debra Jean Sherman, contending that she was exposed to asbestos fibers carried home on the work clothing of her husband, Michael Sherman. Michael …
