Pa. Appellate Court Reverses Judgment for PPG in Asbestos Case, Cites Tooey Decision

PITTSBURGH –– A Pennsylvania appellate court has vacated an order granting PPG Industries’ motion for judgment on the pleadings for claims asserted on behalf of a former employee, saying that the order was issued prior to the state’s decision on the purview of the Workers’ Compensation Act.

In the June 17 opinion, the Pennsylvania Superior Court said that if the plaintiffs’ allegations are true, the underlying claims would not fall under the Act, and the plaintiffs would not be barred from brining common law causes of action against PPG.
