N.Y. Appellate Court Affirms Order Denying Summary Judgment Motion by Crane Co. in Asbestos Case

ROCHESTER, N.Y. –– A New York appellate court has upheld the denial of summary judgment to Crane Co. in an asbestos case, concluding that the plaintiff had established a question of fact as to whether the defendant knew that the asbestos-free components would not be able to withstand the heat for the intended purpose of the valve.

In the June 12 two-page opinion, the New York Supreme Court, Appellate Division, Fourth Department, agreed with a trail court that the plaintiff could continue pursuing the asbestos claims against the defendant.
