Louisiana Federal Court Rejects Asbestos Claims for ‘Lejeune’ Bystander Damages

NEW ORLEANS –– A Louisiana federal court has granted a motion for summary judgment on Lejeune claims in an asbestos case, saying that the plaintiffs cannot satisfy the requirements of bringing such a claim since they did not witness an accident but instead only alleged that they saw the progression of mesothelioma.

In the June 8 opinion, the U.S. District Court for the Eastern District of Louisiana said that the plaintiffs lacked a valid claim for bystander damages under Lejeune.
