AUSTIN –– Both the Texas Senate and House of Representatives have passed legislation that would require asbestos and silica plaintiffs to submit proof of claims filed with trusts or face dismissal of their lawsuits.

House Bill No. 1492 passed the House on May 11 with a 126-11 vote, while the Senate approved the measure on May 22 with a vote of 29-1. The legislation was sent to the Governor of Texas on May 26.

The legislation would amend Chapter 90 of Civil Practice and Remedies Code to add Subchapter B, which would require a claimant who has filed a lawsuit …
