N.C. Court Denies Plaintiff Efforts to Strike In Limine Motion in Asbestos Case

CHARLOTTE, N.C. –– A North Carolina federal court has denied asbestos plaintiffs’ attempts to strike an in limine motion as it pertained to expert Dr. Arnold Brody, saying that the plaintiffs were on notice that the defendants intended to seek the exclusion of “each and every exposure” testimony.

In the May 26 order, the U.S. District Court for the Eastern District of North Carolina said the plaintiffs would not suffer prejudice if the court heard the defendants’ motion.

The plaintiffs contended that Graham Yates developed mesothelioma after he was exposed to asbestos in brake products.
