3rd Circuit Reverses Partial Summary Judgment for Georgia-Pacific in Asbestos Case

PHILADELPHIA –– The U.S. Court of Appeals for the 3rd Circuit has reversed an order awarding partial summary judgment to Georgia-Pacific in three asbestos cases, saying that the federal MDL Court did not apply the correct standard for filing supplemental complaints.

In the May 11 opinions, the 3rd Circuit deferred ruling on whether the plaintiffs had met this standard, or whether their lung cancer claims were barred by the statute of limitations.

The plaintiffs –– Arthur Collins, Dennis Larweth and James Doyle –– asked the 3rd Circuit to review the dismissal of their asbestos claims asserted against Georgia-Pacific. …
