W.Va. Court Affirms Denial of Workers’ Compensation Benefits in Asbestos Exposure Suit

CHARLESTON, W.Va. –– The West Virginia Supreme Court of Appeals has upheld the denial of benefits in an asbestos exposure suit, saying that there was no evidence in the record to support the conclusion that the claimant incurred significant exposure to asbestos.

In the May 7 opinion, the high court further pointed to evidence from several experts that indicated the claimant had not been diagnosed with asbestosis.
