Ohio Supreme Court Declines to Hear Appeal in Dispute over Document in Asbestos Case

CLEVELAND –– The Ohio Supreme Court has declined to hear an appeal of a ruling that allows plaintiffs access to portions of a document prepared by an asbestos defendant’s national counsel, agreeing that the attorney-client privilege was superseded by the plaintiffs’ right to access the information.
The state high court indicated its intent to decline jurisdiction of the matter in an April 29 entry.
The decision effectively affirms an 8th District Court of Appeals of Cuyahoga County opinion. In that order, the appellate court opined that the information sought by the plaintiffs was not provided anywhere else and that …
