Pa. Appellate Court Affirms Summary Judgment Awards in Asbestos Case, Calls Plaintiffs’ Statement ‘Redundant, Confusing’

PHILADELPHIA –– A Pennsylvania appellate court has affirmed a trial court’s award of summary judgment to two defendants in an asbestos case, agreeing that the plaintiffs had waived their right to appeal by filing a “redundant, confusing and incoherent” Pa.R.A.P. 1925(b) statement.

In the May 1 opinion, the Pennsylvania Superior Court said that even if it accepted the plaintiffs’ statement, it would still affirm the summary judgment awards.

The plaintiffs contended in their complaint that George C. Gutschall developed lung cancer as a result of exposure to asbestos while working as a boilermaker at a number of sites.
