La. Court Denies Asbestos Defendant’s Motion for Summary Judgment; Trial Slated for May 11

NEW ORLEANS –– A Louisiana federal court has denied a motion for summary judgment filed by a remaining defendant in an asbestos case scheduled to go to trial this month.

In the April 23 order, the U.S. District Court for the Eastern District of Louisiana opined that “although far from incontrovertible,” the evidence presented by the plaintiff was enough to overcome the summary judgment motion.

A final pretrial conference in the case was held on April 24, at which time the court confirmed at May 11 trial date. Trial is anticipated to last 4-5 days, the pretrial order stated.
