Wis. Appellate Court Reverses Summary Judgment Award Entered In Favor of Asbestos Insulation Supplier

MILWAUKEE, Wis. –– A Wisconsin appellate court has reversed an award of summary judgment entered in favor of an insulation supplier, finding that there a genuine issue of fact existed as to whether the asbestos-containing product was used exclusively for making improvements to real property.

In the April 28 opinion, the Wisconsin Court of Appeals, District I, ruled that once the jury determines what function the insulation was used for, the circuit court can make a legal determination on whether the statute of repose bars the claims.
