Mont. Workers’ Compensation Court Awards Summary Judgment to Insurer in Asbestos Case

HELENA, Mont. –– A Montana workers’ compensation court has awarded summary judgment to National Farmers Union Property & Casusalty Co., finding that the plaintiff was exposed to asbestos for years after the insurer’s coverage of the plaintiff’s employer had ended.

In the April 28 opinion, the Montana Workers’ Compensation Court said that, under the last injurious exposure rule, the insurer did not owe the plaintiff’s employer coverage for the alleged injuries.

Robert Wommack filed the claim, contending that his work for Cenex for approximately 30 years –– starting in 1968 –– caused him to come into contact with asbestos-containing products. …
