Va. Court Reverses Lower Court’s Order Granting Asbestos Plaintiff’s Motion for Nonsuit

RICHMOND, Va. –– The Virginia Supreme Court has reversed an order granting a motion for nonsuit filed by an asbestos plaintiff, saying that the plaintiff was not entitled to such relief since the case had already been submitted to the circuit court for final disposition.

In the April 16 order, the high court found that the case was in the hands of the trial judge at the point the motion for nonsuit was filed, since demurrers to the lawsuit had already been briefed and argued.
