Utah Federal Court Denies Motion for Summary Judgment in Electrician’s Asbestos Case

SALT LAKE CITY, Utah –– A federal court in Utah has denied an asbestos defendant’s motion for summary judgment, finding in part that while the substantial factor evidence presented by the plaintiff is “thin,” the jury should ultimately determine whether it is sufficient to support damages against the defendant.

In the April 9 order, the U.S. District Court for the District of Utah also rejected the defendant’s challenges to the cause of the plaintiffs’ death and whether the claims support damages.
