Pa. Court Affirms Dismissal of Asbestos Wrongful Death Claims, Say Case is Time-Barred

HARRISBURG, Pa. –– A Pennsylvania appellate court has affirmed the dismissal of an asbestos-related wrongful death suit, finding that a 2013 high court decision reinstated a formerly deleted statute governing the applicable statute of limitations for asbestos-related claims.

In the March 19 order, the Pennsylvania Superior Court acknowledged that the current statute may result in some asbestos-related wrongful death actions that are time-barred before they can be filed.

“The statute of limitations on Administratrix’s wrongful death action started to run on June 17, 2011, the date when Decedent was informed by a physician that she had mesothelioma,” the court explained. …
