TEXARKANA, Texas - A Texas Appeals Court has upheld an award of punitive damages to a former laborer exposed to asbestos while he worked around contractors hired to tear out asbestos-containing furnaces and pipes at his place of employment. Brown & Root, Inc. v. Moore, et al., No. 06-01-00148-CV (Texas App. Ct., Sixth Dist.).
In an opinion released Dec. 11, the Sixth District Texas Court of Appeals held that a Morris County District Court jury correctly held that Kellogg-Brown & Root acted with malice in exposing Robert Moore to the asbestos that allegedly caused him to develop mesothelioma. The court …
