Missouri Federal Court Grants Motion to Dismiss but Allows Asbestos Plaintiff Leave to Amend

ST. LOUIS –– A Missouri federal court has granted a motion to dismiss brought by two asbestos defendants, but gave the plaintiffs leave to amend their complaint to plead their claims with the requisite specificity.

In the March 5 order, the U.S. District Court for the Eastern District of Missouri asked the plaintiffs to include specific details regarding the defendants’ products and the alleged time and location of exposure in the re-filed complaint.

The plaintiffs contended in their lawsuit that Charles Campbell Sr., developed lung cancer as a result of exposure to asbestos over a 55-year period.
