Vanderbilt Moves for Sanctions, Says Plaintiff Failed to Disclose Claim Submitted with Asbestos Bankruptcy Trust

WILMINGTON, Del. –– Asbestos defendant Vanderbilt Minerals LLC has moved for sanctions in a Delaware case, arguing that the plaintiffs failed to produce a claim form submitted with the Johns Manville bankruptcy trust in a timely fashion.

According to the defendant’s Feb. 9 motion filed in the Delaware Superior Court for New Castle County, plaintiffs’ failure to disclose the claim form was highly prejudicial since it prohibited the number of parties that Vanderbilt was permitted to put on the verdict sheet.
