Wis. Court Reverses Summary Judgment Award in Asbestos Case, Finds Claims Not Barred under Statute of Repose

MILWAUKEE –– A Wisconsin appellate court has reversed an award of summary judgment in an asbestos exposure suit, finding that the decedent’s injuries were not the result of improvements to real property and were therefore not barred by the state’s statute of repose.

In the Jan. 28 opinion, the Wisconsin Court of Appeals, District I, wrote that the injuries were instead the result of regular, daily repairs.

Pamela Peter brought the claims on behalf of her husband, Donald Peter. Donald Peter, according to the plaintiff, started work as a maintenance machinist at Pabst Brewery in 1959.
