N.Y. Court Denies William Powell’s Efforts to Obtain Costs, Fees in Asbestos Action

NEW YORK –– A New York trial court has denied another effort by the William Powell Co. to obtain costs, counsel fees and disbursements in an asbestos case, ruling that the defendant had not presented new evidence that wasn’t contained in the initial motion.

In the Jan. 28 ruling, the New York Supreme Court for New York County reiterated its position that it had allowed the plaintiff to discontinue his action against the William Powell Co. “without imposing any conditions.”
