N.Y. Jury Awards $20 Million to Family of Shipfitter, Allocates 30 Percent Liability to Boiler Defendant




NEW YORK –– A New York jury has awarded $20 million to the family of a former shipfitter who allegedly developed mesothelioma as a result of exposure to asbestos-containing products, allocating 30 percent liability to the lone remaining boiler manufacturer defendant.

The New York Supreme Court for New York County jury reached the verdict on Dec. 12 after two hours of deliberations and a six-week trial, sources said. Burnham LLC is based on Lancaster, Pa., and sells boilers under the trade name Burnham Commercial. The plaintiffs contended that boilers sold by Burnham Commercial were lined with asbestos-containing insulation.
