N.Y. Court Allows Parties Leave to Appeal Consolidation of Trial Dispute

NEW YORK –– A New York appellate court has allowed Tishman Liquidating Corp. leave to appeal a decision entered earlier this year in which the intermediate appellate court affirmed an asbestos judgment against the company.

In the Dec. 9 order, the New York Appellate Division, 1st Department, denied Tishman’s efforts to reargue the dispute, but said the defendant could seek leave to appeal to the Court of Appeals.

In the same order, the court also granted motions made by several companies to file amicus curiae briefs in connection with Tishman’s motion.
