WILMINGTON, Del. –– A magistrate judge has recommended that a Delaware federal court grant Huntington Ingalls Inc.’s motion to dismiss an asbestos lung cancer case for lack of personal jurisdiction, saying the plaintiffs had failed to prove that the requirements of the state’s long-arm statute had been met.

In the Dec. 3 recommendation, Magistrate Judge Christopher J. Burke of the U.S. District Court for the District of Delaware wrote that the “record was clear” that the defendant had been, for the duration of its existence, a Virginia corporation.
