7th Circuit Affirms Dismissal of Suit Against Owens Corning Asbestos Settlement Trust

CHICAGO –– A federal appellate court has affirmed the dismissal of an action against the Owens Corning Asbestos Personal Injury Settlement Trust, saying that state courts did not err when they rejected efforts of an asbestos claimant to challenge the denial of his claim.

In the Dec. 1 order, the U.S. Court of Appeals for the 7th Circuit opined that the several state courts had properly found that the claimant did not timely reject an arbitrator’s decision that agreed with the Trust’s decision to deny the asbestos claim.
