N.Y. Jury Awards $400,000 in Lung Cancer Asbestos Case; Allocates 3.5 Percent Liability to American Biltrite

SYRACUSE, N.Y. –– A New York jury has awarded $400,000 at the conclusion of an asbestos trial, but allocated just over 3.5 percent liability to the lone remaining defendant, American Biltrite Inc.
The New York Supreme Court for Onondaga County jury reached the verdict on Dec. 4, sources told HarrisMartin. Jurors found American Biltrite 3.57 percent liable for the plaintiff’s injuries and assessed 75 percent liability to the plaintiff for his smoking.
The jury reached the verdict after a 15-day trial and two days of deliberations. Hon. Charles C. Merrell presided over the trial.
