Wash. Court Awards Summary Judgment to IMO Industries in Asbestos Case

TACOMA, Wash. –– A Washington federal court has awarded summary judgment to IMO Industries Inc. in an asbestos case, opining that the plaintiffs had failed to present evidence supporting their claims against the defendant.

In the Nov. 26 opinion, the U.S. District Court for the Western District of Washington said that the plaintiffs had not submitted “specific, probative evidence on every element of their claim.”

“Their failure to either submit facts in response to IMO’s motion or direct the Court to facts already in the record is fatal to their claim,” the court reasoned.
