Boeing Fails in Bid to Assert Federal Officer Removal in Take-Home Asbestos Case

TRENTON, N.J. — An asbestos defendant failed to convince a federal judge that it was acting under the explicit direction of the U.S. government when it allegedly failed to warn third parties of asbestos-related hazards in components used to manufacture military transport aircraft.
In an Oct. 9 decision, Judge Peter G. Sheridan of the U.S. District Court for the District of New Jersey ruled that the defendant, Boeing Co., could not show that it was prohibited by the military from issuing warnings about asbestos-containing aviation materials.
