PHILADELPHIA — A Pennsylvania appeals court affirmed awards of summary judgment for numerous defendants in a take-home asbestos case, ruling that co-worker testimony offered on behalf of the plaintiff failed to produce sufficient evidence of frequent, regular and proximate exposure to the defendants’ products.
The Pennsylvania Superior Court ruled Oct. 3 that while the record in the case includes evidence that asbestos-containing products were present in the workplace of the plaintiff’s husband, none of the evidence places him in proximity of specific products at specific times.
