BATON ROUGE, La. — A Louisiana state appeals court has affirmed a $2.3 million verdict in a mesothelioma survival action, rejecting defense claims that the case was filed too late and that the decedent’s degree of suffering was insufficient to justify an excessive award.
In the Sept. 19 decision, the Louisiana 1st Circuit Court of Appeal also refused an attempt by defendant Charity Hospital to reduce the verdict based on virile shares of three co-defendants that were dismissed from the case prior to trial.
