Calif. Appeals Court Revives Asbestos Trust’s Coverage Action Against State Guaranty Association

SACRAMENTO, Calif. — A California appellate court has reinstated an asbestos trust’s claim against the state’s insurance guaranty association, ruling that the claim is not time-barred because the trust’s complaint does not indicate when it acquired a "covered claim" and a cause of action against the association.
In a Sept. 17 opinion, the California Court of Appeal, 1st District, explained that the applicable statute of limitations is not triggered until the guaranty association denies a specific claim for payment. In this case, the trust has not yet submitted a specific claim to the guaranty association, the court found.
