Union Carbide Awarded Summary Judgment on Failure-To-Warn Claim in Maryland Take-Home Asbestos Case

BALTIMORE — A Maryland federal judge has awarded Union Carbide Corp. summary judgment on a failure-to-warn claim asserted in a take-home exposure case, finding the plaintiff failed to present evidence that improved warnings would have effectively prevented his wife’s exposure.
In the Sept. 16 order, Judge Quarles of the U.S. District Court for the District of Maryland held that while a jury could reasonably infer that it was feasible for Union Carbide to fully inform its customers of the health hazards associated with asbestos dust, the plaintiff failed to prove that a stronger warning would have prevented the alleged injuries.
