Recommendation Awarding Nash Engineering, Air & Liquid Systems Summary Judgment Adopted by Del. Court

WILMINGTON, Del. –– Nash Engineering Co. and Air & Liquid Systems Corp. have been awarded summary judgment by a Delaware federal court, which agreed with a report and recommendation finding that the evidence failed to show “beyond mere speculation and conjecture” that the plaintiff was exposed to asbestos in the defendants’ products.

In a Sept. 8 memorandum, the U.S. District Court for the District of Delaware agreed that the plaintiff’s deposition testimony was sufficient to raise a genuine issue of material fact as to product identification in the case.
