Del. Federal Court Adopts Recommendation, Remands Asbestos Case Against Crane Co.

WILMINGTON, Del. –– A Delaware federal court has adopted a report and recommendation in which a magistrate judge said that an asbestos case should be remanded since the plaintiffs had successfully disclaimed any federal cause of action in their motion to remand.

In the Sept. 8 memorandum, the U.S. District Court for the District of Delaware agreed with the magistrate judge’s assessment that “multiple federal courts have … remanded cases under the circumstances at bar, where a plaintiff expressly disclaims the claims upon which federal officer removal is based.”
