N.Y. Court Sets Aside $3.5 Million Asbestos Verdict Against Premises Owner Con Edison

NEW YORK –– A New York trial court has set aside a $3.5 million asbestos verdict entered against premises defendant Consolidated Edison Company of New York, finding that the plaintiffs failed to prove that the defendant exercised general supervision over workers at the facility.
In the Aug. 29 order, the New York Supreme Court for New York County opined that the alleged asbestos exposure did not occur from a workplace condition created by or known to Con Edison and, as such, the jury erred when it imposed liability on the defendant.
