Asbestos MDL Court Refuses to Enforce Liability on Employer for Take-Home Asbestos Exposure Claims

PHILADELPHIA –– The court overseeing the national Asbestos Products Liability Multidistrict Litigation docket has refused to enforce liability on an employer in a take-home asbestos exposure case, saying that defendant Boeing Co. did not owe a duty under Pennsylvania law.
In the Aug. 27 order, the U.S. District Court for the Eastern District of Pennsylvania wrote that enforcing a duty on Boeing would lead to “limitless liability” and the lack of relationship between the parties “weighs heavily … against imposing such a duty.”
