Ill. Court Remands Asbestos Suit, Cites Voluntary Dismissal of Claims Against 2 Removing Defendants

EAST ST. LOUIS, Ill. –– An Illinois federal court has remanded an asbestos lawsuit, noting that the only two removing defendants have since reached an agreement with the plaintiffs that resulted in the dismissal of the claims pending against them.

In the Aug. 19 opinion, the U.S. District Court for the Southern District of Illinois noted that no other defendant in the action had asserted a challenge to subject matter jurisdiction.

In Oct. 2013, CBS Corp. removed the lawsuit, citing the federal officer removal statute. Crane Co. subsequently moved to join the notice of removal, saying “it too claims application …
