Pa. Appellate Court Asks Trial Court to Reexamine Motion to Dismiss Asbestos FELA Action

HARRISBURG, Pa. –– A Pennsylvania appellate court has remanded a FELA asbestos action asserted against CSX Transportation Inc., asking the trial court to discuss and weigh all the relevant interstate forum non conveniens factors before reaching its ruling.

In the Aug. 12 opinion, the Pennsylvania Superior Court said that the trial court failed to discuss the possibility of alternative forums and all the relevant private interest factors when denying CSX’s motion to dismiss the Kentucky resident’s complaint.
