3rd Circuit Affirms Summary Judgment Award for Georgia-Pacific, Cites ‘Speculative’ Evidence

PHILADELPHIA –– The 3rd Circuit U.S. Court of Appeals has upheld an award of summary judgment to Georgia-Pacific, finding the national Asbestos MDL Court was correct in its determination that the plaintiff had failed to produce sufficient evidence to raise a genuine factual dispute for trial.
In the July 31 opinion, the 3rd Circuit opined that allowing a jury to decide the claims based on the provided evidence would be to invite “pure speculation.”
