Del. Court Reverses $2.86 Million Asbestos Verdict, Cites Improper Jury Instructions

DOVER, Del. –– The Delaware Supreme Court has reversed a $2.86 million judgment entered in an asbestos-containing talc case and remanded for a new trial, finding that the trial court erred when it failed to include jury instructions on the duty of care of the premises owner.

On July 24, the high court further opined that the trial court should not have permitted statements from three separate witnesses that were prejudicial to defendant R.T. Vanderbilt.
