Maryland Court Refuses to Reconsider Order Dismissing Asbestos Claims Against Higbee Inc.

BALTIMORE –– A Maryland federal court has declined to reconsider an order in which it dismissed asbestos claims against Higbee Inc. for lack of personal jurisdiction, rejecting “newly discovered” evidence proffered by the plaintiff.

In the July 24 order, the U.S. District Court for the District of Maryland found that the plaintiff had provided no explanation for why the newly discovered evidence –– depositions that were taken prior to the court’s order dismissing Higbee –– was not brought to the court’s attention before the order was issued.
