Calif. Court Affirms $2 Million Asbestos Verdict; Finds No Fault with Exclusion of Johns-Manville from Verdict Sheet

SACRAMENTO, Calif. –– A California appellate court has affirmed a $2 million asbestos verdict, finding that defendant Pneumo Abex LLC did not properly challenge the trial court’s decision to apply recent case law prohibiting take-home exposure claims against premises owner defendants mid-trial.

In the July 25 opinion, the California Third District Court of Appeal also rejected Pneumo Abex’s stance that the evidence did not support the jury’s allocation of liability to the defendant.

A jury sided with the plaintiffs at the conclusion of the trial, finding that James A. Lovelace’s mesothelioma was caused by exposure to asbestos-containing products. Jurors …
