Louisiana Court Awards Summary Judgment to 4 Asbestos Defendants, Rejects ‘Each and Every’ Exposure Causation Theory

SHREVEPORT, La. –– A Louisiana federal court has precluded the testimony of a causation expert who relied on the “each and every” exposure theory of causation in his expert reports, finding that the testimony neither satisfies federal admissibility standards nor Louisiana’s substantial factor test of causation.

Without the testimony, the plaintiffs’ claims cannot survive, the U.S. District Court for the Western District of Louisiana opined in its July 11 opinion, in which it also awarded summary judgment to four asbestos defendants and closed the case.
