Texas Supreme Court: Flores Dose Requirement Applies to Mesothelioma Cases

AUSTIN, Texas –– The Texas Supreme Court has weighed in on a causation dispute in an asbestos case, finding that case law requiring plaintiffs to present evidence quantifying the dosage of exposure applies to mesothelioma cases.
In the July 11, 6-3 opinion, the state’s highest court did depart from reasoning outlined in an intermediate appellate court opinion, concluding instead that “the plaintiffs were not required to prove that but for [the plaintiff’s] exposure to Defendant Georgia-Pacific Corporation’s asbestos-containing joint compound, [the plaintiff] would not have contracted mesothelioma.”
