NYC Plaintiffs Oppose Defense Efforts to Reargue Court’s Decision Reinstating Punitive Damages in Asbestos Cases

NEW YORK –– Plaintiffs have once again backed a New York trial court judge’s decision to reinstate punitive damages in the city’s asbestos docket, arguing that the court did in fact have the authority to alter the case management order.
In a July 9 brief filed in the New York County Supreme Court, the plaintiffs stated that they received a defense joint motion for leave to renew and reargue the court’s decision to end an 18-year-long deferral on punitive damages in the city’s asbestos cases.
